Terms of Service — ShimmerPic

The service

ShimmerPic is operated by Springtide Labs, LLC, a Delaware limited liability company, and is an independent image creation website using models made available through APIMart. We are not affiliated with or endorsed by OpenAI. Model names identify the options supplied by our provider. Output quality, availability and generation times vary. You must be at least 18 years old to use the service; by using it you confirm that you are. The service is not offered to persons or in territories subject to United States sanctions.

Your account and content

Use an account you control and upload only content you are entitled to use. One account per person: accounts created to get around a restriction or to collect additional free credits may be closed, and their credits are void. Do not use the service for illegal material, sexual content involving minors, non-consensual intimate imagery, fraud or impersonation, content that harasses or demeans a person or group, or synthetic likenesses intended to pass as a real person's identity. Explicit nudity and pornographic content are not allowed. The full list, how screening works and what a refusal costs are in our Content Policy, which is part of these terms. We screen uploads, prompts with references, and generated results before delivery. Provider moderation also applies. You are responsible for checking generated content before publishing or using it commercially.

Repeated refused requests pause image creation, for longer each time, as the Content Policy describes. A request that appears to sexualise a minor closes the account; a non-consensual intimate-image request is refused and may pause the account. You can appeal through our support form and we reply within 7 days. A model-generated result rejected by our screening does not count toward a pause, though its credits are not returned.

We keep a record of every refused request. For requests that appear to sexualise a minor or to sexualise a real person without consent we also keep the prompt and the reference images, in isolated storage, for the period stated in the Content Policy. We disclose these records, and account details such as the registration address, to law enforcement, to the National Center for Missing & Exploited Children, and to our payment and model providers where the law or their terms require it.

Rights and community examples

We do not claim ownership of your prompts or outputs. This does not guarantee that an output is copyrightable, exclusive or free of third-party rights. A new generation can still raise copyright, trademark, privacy or likeness concerns. Explore includes prompts and preview images collected from community sources. Source links and repository license notices are preserved; inclusion does not give you unrestricted rights to every depicted work or image. Report rights concerns through our support form.

Credits and beta checkout

Credits are deducted at the price shown before submission. A confirmed technical failure returns the deducted credits; a request turned down by our content checks or by the provider's does not, whether or not an image came back. If submission status is uncertain, we investigate before returning credits so that a successful task is not charged incorrectly. Credit-pack credits do not expire. Subscription credits expire 90 days after each scheduled monthly grant. Subscriptions renew automatically until cancelled; annual payments release credits monthly. Cancelling renewal preserves the paid period and existing credit expiry dates. Refunds for unused credit-pack purchases may be requested within 14 days as described in our refund policy. Checkout explicitly marked as a sandbox collects no real payment; sandbox credits have no cash value. Only test balances may be reset with notice; purchased balances are not reset as part of beta testing.

Availability and contact

We may suspend or close an account for violations of these terms or the Content Policy, and remove reported material after review; credits on an account closed for a violation are forfeited. Free credits are promotional, have no cash value and may be withdrawn from an account that is restricted. We cannot guarantee uninterrupted service or error-free output. These terms are governed by the laws of the State of Delaware, without prejudice to consumer protections that apply where you live. Nothing in these terms excludes rights or remedies that cannot legally be excluded. We may update these terms; material changes are dated at the top of this page.
